      <description>Authorised Share Capital and Share Transfers Simplified &lt;br&gt; &lt;br&gt;When you register a new company, the most important decision you will make; is who will be the shareholders and how many shares each shareholder will get. When starting a business, the shareholders are usually the people who finance the business and risk their own money in order to make future profits.  &lt;br&gt; &lt;br&gt;The shareholders therefore own the business while the directors manage the business.  &lt;br&gt; &lt;br&gt;You need to decide how many shares you would like to create. These shares are then issued to the shareholders.  The total number of shares that you decided to create is called the authorised share capital and these shares legally belong to the company. They are dormant as they have no rights associated with them until they are issued to the shareholders. The rights such as voting rights or preferential dividend pay-outs are binding only once the shares are issued to the shareholders.  &lt;br&gt; &lt;br&gt;You can choose any number of shares to make up the authorised share capital. We used 1200 shares as our default amount. This is because you can’t own a fraction of a share. This becomes a problem if your authorised share capital is 1000 and you have three equal shareholders all wanting 1/3 ownership. 1000/3 = 333.33 The problem is the .333 of a share, which is not allowed. So, the 1 share will then either have to be jointly held or remain unallocated with the company.  &lt;br&gt; &lt;br&gt;Therefore 1200 is a more practical number as it is devisable by most numbers. For example, if you are three equal shareholders then each shareholder will get 400 shares. 1200/3 = 400 and there are no factions to complicate the transaction.  &lt;br&gt; &lt;br&gt;Just to complicate matters, you do not have to issue all the authorised share capital to the shareholders as some shares can remain unallocated with the company.  &lt;br&gt; &lt;br&gt;The amount of authorised share capital is stated in the Memorandum of Incorporation or MOI which you will receive when you register your company. It describes the number and types of shares and the rights and limitation associated with each class of shares. We use the standard MOI as drafted by CIPC as it is cheaper and already compliant with the Companies Act. It also only has a single class of ordinary shares to simplify matters. There is no need to concern yourself too much with this document when registering your company as it can always be amended at a future date.  &lt;br&gt; &lt;br&gt;The next concept to get to grips with is the number of authorised shares has nothing to with the value of the company. Many of our clients get confused with this as they feel that the more shares they create when establishing the business, the more valuable their company will be.  &lt;br&gt; &lt;br&gt;This is definitely not the case; this is because the value of a company is completely independent of the number of shares. The value of the of a company is based on many factors, but in the end, it boils down on what a willing buyer and a willing seller agree upon and has nothing to do with the number of shares.  &lt;br&gt; &lt;br&gt;Let me give you an example: Let’s assume the company is valued at R1m. To determine the value of each share you must divide the value of the company by the number of issued shares.  &lt;br&gt; &lt;br&gt;For example, let say we have 100 issued shares in total. The value of each share is therefore calculated by dividing the value of the company by the number of issued shares 1,000,000/100 = R 10,000 per share. But I first need to outline the basics of COID.  &lt;br&gt; &lt;br&gt;COID is a government insurance fund whose purpose is to compensate employees who are injured, or disabled at work and to compensate the dependents of those who die while at work.  It protects the employer from any civil claims made by employees which is a major benefit as all parties are effectively covered.  &lt;br&gt; &lt;br&gt;COID or COIDA stands for Compensation for Occupational Injuries and Disease the A stand for the ACT so most people just refer to the registration as COID.  Money is collected from the businesses and goes into a compensation fund known as the Workmen’s Compensation Fund which is used to pay out the funds in the case of successful claims.  &lt;br&gt; &lt;br&gt;So who needs to register for COID?  &lt;br&gt;The short answer is every business. There are a few exceptions such as government departments and certain mining and building sectors which are exempt as they have their own separate insurance. But other than that, every business should register for COID.  &lt;br&gt; &lt;br&gt;There are 2 main reasons why companies should register for COID;  firstly, for the insurance cover; as many small businesses will not be able to withstand a large unexpected claim such as a  medical bill and secondly, many tenders require a COID registration with a Letter of Good Standing. The Letter of Good Standing is a certificate stating that your company is registered for COID and all your payments to the compensation fund are up to date.  The Letter of Good Standing gives the business that you are contracting with, peace of mind as they will not be liable for any injuries to your staff which took place on their premises.  &lt;br&gt; &lt;br&gt;So how do I get my Letter of Good Standing?  &lt;br&gt;This is a two stage process; firstly, you have to be registered for COID and have submitted your Return of Earning to the Department of Labour.  The Return of Earnings is an estimate of the total of your projected staff salaries (both full time and part time, but excludes owners salaries) for the year in advance. This total projected wage bill will be used to calculate what is due to the compensation fund.   The contributions vary depending on the type of business and its risk profile so if the business is in a higher risk sector then the contribution will be more.  &lt;br&gt; &lt;br&gt;The second stage is for the Department of Labour to assess the Return of Earnings. This usually takes about 3 days after which they will send a Notice of assessment with the amount due to the compensation fund. Once you have settled this a Letter of Good Standing will be issued.  &lt;br&gt; &lt;br&gt;Employers are obliged to register for COID within 7 days after the date the first employee starts working; while the return of earnings must be submitted each year on or before 31 March.  The letter of good standing is valid from 1 April until 31 March of the following year.       <description>In this video I will explain everything you need to know about Par Value Shares with regards to company shares; also referred to as Face Value or Nominal Value shares.  For purposes of this video we will just call them Par Value shares and should not be confused with bond par values as bonds and shares are unrelated.   &lt;br&gt; &lt;br&gt;Par Value Shares is a concept dating back hundreds of years when markets were unregulated and investors had limited information. The concept was introduced to protect investors by setting a fixed minimum value for which a share can be traded at.  This fixed minimum share price was called the Par Value.  However, is has little relevance in today’s environment as we have so much access to information so that concept is very outdated.   &lt;br&gt; &lt;br&gt;We all know that the value of a share does not remain fixed; they go up and down depending on what a willing buyer and a willing seller agree upon. The difference between the actual trading value of a share and the par value is called the share premium. The share premium is used to balance the companies books.   &lt;br&gt; &lt;br&gt;Lets look at an example. Company A has set the par value share price for a single share low at R1 while Company B has set it high at R40 for a single share.  Let’s assume that the actual value of a single share of the company is trading at R20 per share. To balance the books the par value plus the share premium must equal the actual value.  Therefore, in the case of company A the share premium is a positive value of R19. The opposite is true for company B which has a negative share premium of R20.  &lt;br&gt; &lt;br&gt;So what does this actually mean? If company B goes bankrupt, the shareholders are liable for the share premium of R20 per share.  This is not the case for company A where the shareholders have no risk. To limit the liability of the shareholders most companies which still have Par Value shares set the value as low as possible. &lt;br&gt; &lt;br&gt;In South Africa the Co-op Act which uses Par Value shares is contradictory when applying this philosophy. On the one hand it will be in the members interest to set the par value price low for example R1 to limit the shareholders liability towards the Co-op. On the other hand the standard constitutions as drafted by CIPC values shares on termination and death according to Par Value and not the actual value. In this case it would be beneficial for the receiving party; for the par value to be set as high as possible.   &lt;br&gt; &lt;br&gt;Having considered both sides of the argument I would recommend that the Par Value shares for Co-op be set as low as possible and the standard constitution be amended to value all shares on termination and death on the actual value and not Par Value.</description>

In this video I am going to explain the basics, show you how to register your own trademark and share two important tips.   &lt;br&gt; &lt;br&gt;In South Africa all Trademarks need to be registered with CIPC.  For International Trademark protection I would suggest consulting with a Trademark Attorney as this process can be complex and expensive as different countries have varying legal requirements.   &lt;br&gt; &lt;br&gt;So how does the protection work?   &lt;br&gt;In terms of the law, a trademark infringement happens when there is a likelihood of confusion between your trademark and your competitors who have copied or are imitating your brand. The competitor will be ordered to stop confusing and misleading the public and may be liable to pay damages to you. Trademarks therefore effectively ensure that a brand is easily identifiable and distinguishable from others. In doing so it also protects the consumer by ensuring that they purchase the product they intended to and not a competitor by mistake.  &lt;br&gt; &lt;br&gt;The most common types of trademarks are word marks and logo’s. I like the KFC example as it has a both a word mark and a logo. KFC is the word mark and the bucket is the logo (See logo) you can also have a combination of the two, (See Combo) Keep in mind that each type of trademarks is a separate application. There are other types of more non-traditional trademarks such as shapes or colours but for these I would recommend you get some assistance.  &lt;br&gt; &lt;br&gt;You should be aware that there are certain things you can’t trademark, such as the national flag or national symbols such as Table Mountain. Its also a good idea to avoid common expressions such as 24hours, cheese or server. CIPC is also unlikely to approve a wordmark using superlatives such as words such as biggest, best or fastest. &lt;br&gt; &lt;br&gt;So how do you register a trademark?  &lt;br&gt;We offer two methods of registering trademarks. There is a cost effective DIY option where you lodge the trademark directly on our website using our easy to use system which will prompt you along the way. The second option is Lawyer assisted option where we have partnered with a one of South Africa’s leading firm of Trademark Attorneys who will assist you.. They will do a thorough availability search and will advise you on the correct class selection as well as write appropriate descriptions for the trademark. Your trademark will have a better chance of success with the second option.  &lt;br&gt; &lt;br&gt;Let me explain the class selection. All Trademarks need to be classified into one or more classes. There are forty-five (45) broad categories of goods and services.  When filing a trademark application, it is essential to identify which class or classes of goods or services you wish to cover. For example Class 25 includes most types of clothing, footwear, and headgear. This means that your trademark will be only be protected in that class.  Each class is seen as a separate application and therefore has a separate filing fee. &lt;br&gt; &lt;br&gt;So how does the process work?  &lt;br&gt;Once you have submitted all of your information and paid the fees due,  we will lodge the trademark with CIPC, which usually takes about 5 working days for them to issue a receipt with the filing number and date.  At this point you may use the abbreviation TM on all your products to show that a trademark registration is in process. The actual assessment by CIPC of the application may take up tp 12 months time, no I’m not joking, this is due to their massive backlog. &lt;br&gt; &lt;br&gt;However, it is important to note that the protection starts from the initial filing date. Only once the trade mark is registered, may you use the symbol ®.  If the Trademark is approved after a year it is then advertised in the Government gazette for 3 months, after which a registration certificate will be sent to the you via email. The entire process could take up to 18 months. &lt;br&gt; &lt;br&gt;Your trademark will now last you for 10 years before you will need to renew it. It is now an asset which you can sell.  &lt;br&gt; &lt;br&gt;Finally, I must just clear up some confusion between Trademarks, Copyright and Patents. All three offer intellectual property protection, but copyright is for creative works such as music, books or songs while patents are to protect inventions.  &lt;br&gt; &lt;br&gt;I would like to end of by offering two helpful tips which will go along way to ensure your trademark is successful.  &lt;br&gt;1. Be as creative and original as possible &lt;br&gt;2. Be distinctive: you can’t just describe the trademark in a generic manner</description>

We have found that most of our clients prefer to apply for both import and export licenses at the same time as the procedures are identical. Even if you are currently planning to only export or alternatively only  import, we recommend applying for both licenses as one never knows what is around the next corner and you may need to change your business strategy in the future. The license is enduring as it doesn’t expire and will belong to you or your company indefinitely. There are also no annual renewal fees or reviews, so once you have the license it is yours permanently.  &lt;br&gt; &lt;br&gt;According to the latest regulations you must have an import export license (also known as a customs code) to import or export cargo which is worth more than R50,000 or if you have made more than 3 imports or exports in a calendar year. This customs code is also called the CNN number and it is this code that you have to present to Customs in order to clear your goods.   &lt;br&gt; &lt;br&gt;You can apply for an import export license in your personal name or in the name of a company. I personally would recommend that you apply for the customs code in a company name as it has all the benefits of limited liability as well as the tax advantage of conducting business in a company name. If you want to know more about this topic, please watch my video on the benefits of registering a company (Here) &lt;br&gt; &lt;br&gt;Your customs code will allow you to:   &lt;br&gt;1. Import or Export any type of goods (unless of course they are prohibited). &lt;br&gt;2. It also allows you to trade with any country in the world &lt;br&gt;3. Plus, there is no limits on the quantity of goods.  &lt;br&gt; &lt;br&gt;If you are exporting goods to Europe or Southern Africa (SADC), we would recommend that you also register for a EUR1 or SADC certificates so that you can benefit from the import duty tax reductions and exemptions.  You can apply for these registrations at the same time as your Import Export license. &lt;br&gt; &lt;br&gt;So how do you register?  Log on to our site and select Import Export License.  This will take you to the page where you can select which services you would like to register for.  Click the button for email and we will send you the one page application form. Once you have paid the registration fees, we will send you the necessary documents for completion which can then be emailed back us and we will do the rest.  &lt;br&gt; &lt;br&gt;The entire process should take approximately 10 working days from when we get all of the documentation. You can either register a brand new company from scratch, I’ve already done a video covering that topic, and second option is to purchase a preregistered company, also known as a shelf company.    &lt;br&gt; &lt;br&gt;One of the benefits of a our shelf companies is that they all have registration numbers from the previous year which gives the impression that your business is older and has been operating for longer than companies which are newly registered.  This can lend credibility to your company as there is a perception that the business has been operating for some time as is not just another new start-up.  Just like antiques the older the company the higher the value in the eyes of your customers and suppliers.  &lt;br&gt; &lt;br&gt;All of our shelf companies are dormant which means that they have no assets, no liabilities and have never done any business.  The CIPC annual returns are up to date so there are no additional costs associated with the shelf company.  &lt;br&gt; &lt;br&gt;The first advantage of purchasing a shelf company is speed, you will receive the registration number and the tax number almost instantly. This is very convenient should you be working to a tight deadline such as a tender.  The second advantage of our aged shelf companies is the fact that they are more than six months old; which is often a requirement when signing lease agreements.  &lt;br&gt; &lt;br&gt;We have preregistered our shelf companies with without names and have opted instead to use the registration number which starts with a K.  Effectively the K Number is the name of the company. When you purchase one of our shelf companies you have the option to keep the company as the K number or apply for your new name which you select.  &lt;br&gt; &lt;br&gt;Should you choose to change the name of the company the registration number remains the same, so the advantage of the aged shelf company remains.  &lt;br&gt; &lt;br&gt;In the past a small number of shelf companies have been used for fraudulent activities which has given them a bad reputation. To ensure that there is no misuse of our shelf companies we include the address change, director change, shareholder change as part of the service as well as a B-BBEE affidavit. &lt;br&gt; &lt;br&gt;We have optimised these processes in the most succinct and sequential workflow to ensure we complete the changes in the shortest possible time. &lt;br&gt; &lt;br&gt;So how do I purchase a shelf company?  &lt;br&gt;Simply log on and decide if you would like a shelf company with a name or without. Once you have selected your option it is just a matter of capturing the relevant data which they system prompts you to do.  Once you have captured the data you will be prompted to upload the supporting documents such as the signed limited power of attorney, IDS and proof of payment. That’s it! The system is even easier for mobile phones as accepts finger signature therefore making the process paperless.  We have received great feedback for the user-friendliness of the process. &lt;br&gt; &lt;br&gt;Once you have completed the online application, you can expect to get the Registration number, tax number and Cor 14.3 within 24 hours. The company name change and directors appointment will still need to go through our CIPC workflow, but once that is completed we issue the share certificates and BEE affidavit on the same day. &lt;br&gt; &lt;br&gt;There you have it, quick and straight forward, please give it a try and let me know how it went. Once you are registered with CIDB you will be notified when relevant tenders open for application. &lt;br&gt; &lt;br&gt;If you are in the home building industry then you will need to register with National Home Builders Regulatory Council or (NHBRC) which is an agency of the Department of Human Settlements and not Public Works and does not form part of this video.  &lt;br&gt; &lt;br&gt;The CIDB registration consist of 2 criteria; your business track record, which is represented by the grade 1 to 9 and construction sector which is selected from the predetermined list of class of works. The grading system works on the size of the contracts that you have had in the past, your financial and works capability and your capacity to perform projects so new businesses would register as a grade 1.   &lt;br&gt; &lt;br&gt;The class of works has 20 different construction sectors ranging from civil and electrical work to general building. You can apply for as many classes as you like, but just bear in mind that each class cost R450.  &lt;br&gt; &lt;br&gt;Your CIDB registration grade and class means that you are only certified to carry out work in the class in which you are registered and up to the maximum value of work permissible for that grade.  You will therefore compete against contactors with the same grading which promotes fairness and transparency.   &lt;br&gt; &lt;br&gt;Subcontractor and “labour only” contractors do not have to register for CIDB. &lt;br&gt; &lt;br&gt;The registration is valid for three years, before it must be renewed. CIDB no longer issues physical certificates as you will be notified electronically via SMS and email when your registration is active and registered on the Register of Contractors where you can view your status online.  &lt;br&gt; &lt;br&gt;So, what do you need to register for CIDB? It is the usual Company documents, Director and Shareholder ids, a valid Tax clearance and BEE certificates.  Please sign and date the attached CIDB declaration and email the documents to us. This registration requires a one hour open book test and the fees for the project enrolment for the NHBRC Warrantee Fund can be up to R34,000 per project, so buckle up.  &lt;br&gt; &lt;br&gt;Just to be clear the NHBRC regulates the home building industry in South Africa, meaning every new structure designed for human habitation must be registered with the NHBRC. The rest of the construction industry is regulated by Construction Industry Development Board or CIDB which falls under the Department of Public Works. I have made a separate video on this topic.  &lt;br&gt; &lt;br&gt;The NHBRC is a SOE which falls under the Department of Human Settlements whose aim is to regulate the home building environment by enforcing strict building standards and guidelines to control the quality of the building work. A very noble cause.  &lt;br&gt; &lt;br&gt;To do this, it requires funding which it gets from the registration, renewals and the warrantee fund. This warrantee fund is the big daddy and derives its income from each new building project.  The builder is required to pay the NHBRC a percentage of the building value including the land up to a maximum of R34k. Only once the funds have been paid will the NHBRC gives permission for the building work to commence. As you can imagine this fund is massive and is currently valued at R6.6 Billion &lt;br&gt; &lt;br&gt;This money is used to repair any defects should the builders abandon the project and not rectify the faults. So in essence it’s an assurance for the home owner that the home will be completed to the required standards. The warrantee fund covers all structural work for 5 years, roof leakages for 1 year and finishes for 3 months. It will pay up to a maximum of R0.5m per project. The fund has on average paid R10m per year in claims which amounts to only 0.0015% of the fund.  &lt;br&gt; &lt;br&gt;So who should register with the NHBRC? All Home Building Companies must be registered as well as each home building project must be enrolled with the NHBRC. One of the requirements for the building company to be registered is that one of its representatives, usually the technical manager must pass a 1 hour open book test within two weeks of registering the company with the NHBRC. You only have two opportunities to pass the test or your application will be rejected and the registration fee of R740 will be forfeited.  &lt;br&gt; &lt;br&gt;The course material for the test comprises of the South African National Standards Book and the Home Builders Manual which must be purchased from the NHBRC at a cost of R3200 (however it can also be rented for R90 per day) &lt;br&gt; &lt;br&gt;In practical terms how does the oversight work? Lets assume the building company is already registered with the NHBRC. Now, 15 days prior to the start of the new building project, the development must be registered with the NHBRC. This is when the builder has to pay the money to the Warrantee Fund. Assuming everything is in order the NHBRC will issue a commencement certificate and the construction can start.  &lt;br&gt; &lt;br&gt;At various crucial building phases such as Foundations, Super Structure, Practical Completion and Storm Water the NHBRC inspector must visit the site to sign off on the quality of the workmanship. It is a good idea to contact the inspector beforehand to arrange an appointment as this will prevent costly delays for the contractor. It is good to note that the NHBRC does offer free training for aspirant builders to ensure the building quality meets the required standards.  &lt;br&gt; &lt;br&gt;How does the registration process work? First the application form must be completed. It is reasonably detailed and it requires professional references. Once this it completed the registration fee of R740 needs to be paid after which the company has 2 weeks to write the open book test. On successful completion of the test you will need to pay the annual fees of R530 before your certificate will be issued to you in person at your local NHBRC branch.  Good luck I am sure you will ace the test.  &lt;br&gt; &lt;br&gt;To end off, I must warn all home builders that it is compulsory to register with the NHBRC as failure to do so could result in a R25000 fine or imprisonment for up to a year for each of the directors. It legally requires every individual, business and training facility operating in the security industry to be registered with them. This includes everyone from security guards, private investigators, locksmiths, security manufacturers and installers.  &lt;br&gt; &lt;br&gt;The private security industry is massive with over 11k registered security companies and 0.5m active registered security officers. By comparison The South African Police service has 150k police officers which makes the private security industry nearly 4 times larger than our police force.   &lt;br&gt; &lt;br&gt;To fund the oversight of the industry; PSIRA requires each individual, security business and training facility to pay a host of annual fees.  This table show the comprehensive list of the various fees which in total generates more than R300m each year for the state owned entity. &lt;br&gt; &lt;br&gt;Security is a serious business and shouldn’t be entered into lightly.  It requires substantial investment and stringent adherence to the registration requirements with heavy penalties and forfeits for non-compliance.  My recommendation is that you should only register a security business if you have a minimum of R50,000 available to invest in the venture. &lt;br&gt; &lt;br&gt;Before this process can even start all the directors of a security company are required to complete compulsory training up to Grade B at an accredited security training facility. This training is separated into five grades; starting with grade E as the entry level and ending with grade A for Managers. Each grade usually takes about a week of training and for directors of security companies, a grade B qualification is the minimum requirement. Therefore, as a prospective director, you can plan on 4 weeks of training which will set you back a few thousand rand.  &lt;br&gt; &lt;br&gt;On completion of your training, the training facility will forward your the course report to PSIRA who will then create a PSIRA registration number for you which allows you to track the application online. This process is only available to individuals with a South African ID number. You will then need to complete the individual application form which includes fingerprints and a police clearance certificate. Once you have paid your individual registration fees to PSIRA they will notify you to collect your certificate at their branch, but be warned you will be turned away if you don’t make a booking in advance; either online or via the WhatsApp number. This process usually takes 6 weeks The good news is that you only have to do the training once, however individuals are required to pay renewal fees every two years and businesses every year to keep their certificates active.   &lt;br&gt; &lt;br&gt;Let’s assume the directors of the company have done their training and have received their individual PSIRA registration numbers. The next step is to get the company registered. This is also a pretty comprehensive process, starting with the company documents and shareholders declaration.  They also require a business plan which should include a 1 year financial projection to demonstrate the viability of the business as well as an infrastructure plan where an inspector from PSIRA pays a site visit.  Furthermore, you will need a tax clearance, if applicable firearm licenses, resolution to nominate an authorised party to sign the application documents on the company’s behalf as well as personal sureties and a design for a business insignia.  So, as you can see it is very comprehensive &lt;br&gt; &lt;br&gt;I would just like to draw your attention to the surety, this is where the individuals, either the directors or the owners of the company stand surety in their personal capacity for any fees due to PSIRA on behalf of the business. This is an onerous document so be sure to read and understand it before you sign it.  &lt;br&gt; &lt;br&gt;To gain better understanding of the costs associated with the registration; I have taken a new start-up security company as an example and broken down the application process into five phases.</description>

There are two main categories of tender providers namely the government and private companies. The government has over 900 different departments which include national, provincial and municipal departments. If you want to apply for a tender from any of these departments, you first have to register on the Central Supplier Database or CSD.  If you haven’t registered with CSD already; I would recommend you watch my video on this topic. The good news is that you only have to register once on the CSD as all the government departments refer to this database for compliance, so if all your data is accurate and up to date, you are good to go.  &lt;br&gt; &lt;br&gt;The second major category of tender providers is the private sector. For private companies it is not a requirement to register on the CSD database, but you have to register on the respective vendor databases of each company this means you will have to repeat the registration process for each individual company, should you wish to register with them. Most private companies have closed tenders meaning only bidders registered on their database are invited.  &lt;br&gt; &lt;br&gt;For both Government and the private sector B-BBEE certification is a key requirement for all tender applications. If your company turnover is less than R50m per year you only need an affidavit and not a certificate issued by an accredited verification agency which can be very expensive.  &lt;br&gt; &lt;br&gt;If you would like more information on BEE certification, I have made a video on this topic too. But just to recap, small businesses with turnovers of less than R10m are defined as an Exempt Micro Enterprise and depending on the percentage of black ownership in the company; the BEE level will be either Level 1 for 100% black owned companies or level to 2 for between 99 -51% black ownership and Level 4 for everything less than 50% black ownership companies.  &lt;br&gt; &lt;br&gt;So how does your BEE status effect your tender? To understand this question, you must first get to grips with the tender evaluation points system. Let me explain, each tender is ranked out of a maximum of 100 points and the bidder with the most points is awarded the tender.  &lt;br&gt; &lt;br&gt;Now, depending on the value of the tender, different procedures are followed. For tenders valued at between R30k and R50m the 80/20 points system is used. What this means is that 80 of the 100 points are based on the price of the tender and the remaining 20 points are based on your B-BBEE status. For tenders above R50m the points system changes to a 90/10 ratio.   &lt;br&gt; &lt;br&gt;This may all sound a bit complicated so let give you an example.  In this table you will see the BEE statuses on the left ranging from one all the way down past 8 to non-compliant. The middle and righthand columns reflect the number of points allocated for the 90/10 and 80/20 systems respectively. Therefore, if you have a level 4 B-BBEE status and you are tendering on a job valued below R50m you will have look at the 80/20 column, where you will be awarded 12 points out of a possible 20. I hope this makes some sense to you.   &lt;br&gt; &lt;br&gt;Now most importantly, the evaluation committee still needs to award the points for the price of your tender. To do this, your price is compared to the lowest acceptable bid and expressed in points using the following mathematical formula: Points = 80 x (1-((Your price-lowest acceptable bid)/lowest acceptable bid)) This formula determines how many points you get out of 80 for your tender price, with the lowest bid receiving the most points. Remember this example is based on the 80/20 system because the tender value is below R50m.  &lt;br&gt; &lt;br&gt;Now that both the price and the BEE points have been calculated, the committee adds them together and the bid with the highest score will be awarded the tender.  &lt;br&gt; &lt;br&gt;So, where do you find the tenders? There are a multitude of website such as etenders, greengazette, cidb and the dtic. The challenge with looking for tenders using this method is that it is time consuming and tedious as the tender information is scattered across these websites.
